TERMINOS Y CONDICIONES DE VENTA NUESTRO CAFE,S.A.

1. NUESTRO CAFE,S.A, es una sociedad formada en Guatemala, por lo que se apega a las leyes nacionales del país. (NUESTRO CAFE, S.A, is a company formed in Guatemala, so it adheres to the national laws of the country).
2. Las facturas tienen condiciones de paga diferentes para cada cliente, favor revisar bien en su factura la condición de pago y limite de días de crédito. De no llegar a un acuerdo de pago con NUESTRO CAFE,S,A. la empresa se reserva el derecho de contratar una tercera empresa para ejecutar el cobro. NUESTRO CAFÉ, S.A. estará autorizada a suspender todo servicio de entrega o facturación, en el caso que el cliente no proceda a su pago en los días convenidos.     (The invoices have different payment conditions for each costumer, please check the payment condition and credit days on your invoice. If you do not reach a payment agreement with NUESTRO CAFE, S, A. the company reserves the right to hire a third company to execute the PAYMENT. NUESTRO CAFE, S.A. will be authorized to suspend all delivery or billing services, if costumer does not proceed payment on the agreed days.            
3. Si el pago se extiende mas de 60 días después de vencido la fecha de cobro, NUESTRO CAFE S,A. se reserva el derecho de contratar una tercera empresa para ejecutar el cobro y todos los gastos correrán por cuenta del cliente. (If the payment extends more than 60 days after the due date, NUESTRO CAFE S,A. reserves the right to contract a third company to execute the payment and all expenses will be borne by the costumer).
4. Determinados países aplican retención en la fuente sobre el importe de las facturas, de acuerdo con su legislación interna. Cualquier retención en la fuente será pagada por el cliente a las autoridades fiscales. En ningún caso NUESTRO CAFÉ, S.A. podrá involucrarse en costes relacionados con la legislación de un país. El importe de la factura será por tanto a cargo de NUESTRO CAFÉ, S.A. en su totalidad y no incluye los gastos correspondientes a la legislación del país en el que se encuentre el cliente. (Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can NUESTRO CAFÉ, S.A. become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to NUESTRO CAFÉ, S.A. in its entirety and does not include any costs relating to the legislation of the country in which the client is located.)
5. NUESTRO CAFÉ, S.A. se compromete a hacer todo lo posible para prestar los servicios en tiempo y forma de acuerdo con los plazos acordados. Sin embargo, ninguna de sus obligaciones puede considerarse como una obligación de lograr resultados. NUESTRO CAFÉ, S.A. no podrá, en ningún caso, ser requerida por el cliente a comparecer como tercero en el marco de cualquier reclamación de daños y perjuicios interpuesta contra el cliente por un consumidor final. (NUESTRO CAFÉ, S.A. undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. NUESTRO CAFÉ, S.A. cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer).
6. Para que sea procedente, cualquier reclamación deberá ser notificada a NUESTRO CAFÉ, S.A. mediante carta enviada por correo certificado a su domicilio social en el plazo de 8 días desde la entrega de los bienes o la prestación de los servicios. (In order for it to be admissible, NUESTRO CAFÉ, S.A. must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.)
7. Todas nuestras relaciones contractuales se regirán exclusivamente por la ley de Guatemala. (All our contractual relations will be governed exclusively by Guatemala law).
